Terms of Service for HerePic

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the HerePic mobile application and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

2. Who We Are

HerePic is operated by Jenario ("we," "us," or "our"). For questions, contact dario@jenario.com.

3. Eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority, you may use the Service only with parental consent.

4. Accounts and Security

• You may use parts of the Service without an account; some features require authentication.
• You are responsible for safeguarding your credentials and activity under your account.
• Notify us of any unauthorized access immediately.

5. User Content and License Grant

"User Content" includes photos, videos, captions, reactions, profile information, and other content you submit. You retain ownership of your User Content.

6. Prohibited Conduct

• Illegal, infringing, harassing, hateful, violent, pornographic, or otherwise objectionable content.
• Doxxing or posting private/sensitive information about others.
• Encouraging dangerous or unlawful activity at specific locations.
• Spam, engagement manipulation, or interference with the Service.
• Reverse engineering or scraping without permission.

7. Location, Camera, and Device Permissions

The Service uses location and camera/photos access to enable core functionality. Some features may not work without these permissions. For details on how we handle your data, see our Privacy Policy and Data Handling Summary.

8. Community and Safety

We aim for a respectful, location-aware community. Our Community Guidelines explain what is allowed and how we moderate content.

9. Intellectual Property

Except for your User Content, the Service is protected by intellectual property laws. You may not copy or modify Service content without permission.

10. Third-Party Services

We use third-party providers (e.g., Supabase, Expo, Apple, Google, YouTube). Their terms and policies may apply.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. YOUR USE IS AT YOUR SOLE RISK.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE. OUR TOTAL LIABILITY WILL NOT EXCEED $100 OR THE AMOUNT YOU PAID US IN THE LAST 12 MONTHS.

13. Indemnification

You agree to indemnify us from claims arising from your use of the Service, your User Content, or violation of these Terms or applicable law.

14. Termination

We may suspend or terminate access at any time for violations or to protect the Service or users.

15. Governing Law

These Terms are governed by the laws of the State of California, USA. Venue lies in San Francisco County, California.

16. Changes

We may modify the Service and update these Terms. Material changes will be communicated in-app or by updating this page.
